Orlando Stalking AttorneysThis month I have been to Court in Broward, Palm Beach, Osceola and Orange County! I managed to get the State Attorney’s Office to dismiss a D.U.I. charge one of my clients was facing. Also, I settled a case which I have been litigating for over a year just prior to the case being set for trial in Broward County, Florida. Finally, I successfully resolved an outstanding FIGA claim that involved major remediation work that was performed at a commercial property in Broward County. Just when my client sought payment, the insurance company went under and all claims were turned over to FIGA. Finally, after a long delay FIGA finally agreed to pay the full amount my client was owed for their services.Insurance ClaimsHB 909 defeated! Through the combined efforts of many contractor’s, attorneys and lobbyists, House Bill 909 was amended and contractors still have the ability to use assignment of benefits on their insurance claims. This is a crucial victory for us against the powerful insurance companies and their lobbyists. In the end, our elected officials did the right thing and excluded the anti-assignment provisions from the final bill. However, this is just the start of the challenge. You can be assured that the insurance companies will be back again next year lobbying for the same language to be included into another bill so now is the time to stay together, organize and be more prepared for the challenges that lie ahead. Injury Claims: Often times clients come to me and tell me how they sustained an injury but never decided to follow up on the claim because they did not want to sue anybody. Remember friends that you can file a claim for an injury sustained in a car accident, at another persons home (Dog Bites etc) or if you are injured at a business. Most people and businesses carry insurance to cover for those types of claims and lawsuits are only filed if the insurance company decides not to pay a reasonable amount to settle the injury claim. Lawsuits are not filed on every injury claim and therefore it is a misconception to think that in order to be compensated you need to file a lawsuit. In fact, most cases are resolved without the need for a lawsuit.
